Terms & Conditions
Applicable to submissions, sponsoring, tickets, jury participation and event attendance.

The German version of these Terms & Conditions is the legally binding one. This English translation is provided for convenience only. In case of discrepancies, the German version prevails.
1. Scope
1.1. These General Terms and Conditions ("T&C") govern the legal relationships between the organisers (Section 2) and any person or entity participating in the AI Imagination Award, in particular as entrant, sponsor, jury member, ticket buyer or event attendee ("Participant").
1.2. By submitting an entry, booking a ticket, signing a contract or attending the event, the Participant accepts these T&C in their valid version.
1.3. Any conflicting, deviating or supplementary terms of the Participant only become part of the contract with the express written consent of the organisers.
1.4. The organisers reserve the right to amend these T&C at any time. For ongoing contracts, the version at the time of contract conclusion applies, unless the Participant expressly consents to a newer version.
2. Organisers
The AI Imagination Award (also "AIIA" or "Award") is jointly organised by:

- ENDLIVITY Creative Labs, owner: Mathias Kniepeiss, Mollardgasse 2/11, 1060 Vienna, Austria. Email: info@mathiaskniepeiss.com.

3. Subject matter of the contract
Depending on the constellation, the contract covers: (a) participation in the Award through submission of work in the announced categories, (b) sponsorship services pursuant to individual agreement, (c) participation as a jury member, (d) the purchase of tickets and attendance of the event, and (e) the use of the website imagination-award.ai.
4. Submissions
4.1 Requirements
Submissions are only possible within the categories, time periods and format requirements published by the organisers on the website. Entrants must be of legal age; an exception applies to the "Emerging Talent Award" special prize, which is open to persons up to the age of 18. For minors, the written consent of their legal guardians is required.
4.2 Submission fee
The organisers reserve the right to charge a submission fee per category in the amount stated on the website. Submission fees are non-refundable, except in the case of full cancellation of the Award by the organisers.
4.3 Entrant warranties
By submitting, the entrant warrants that:
- (a) they are the author of the submitted work or have validly acquired all necessary usage and exploitation rights;
- (b) no third-party rights, in particular copyright, personality, trademark or data protection rights, are infringed;
- (c) any rights related to AI training data or AI-generated content used have been clarified, where contractually or legally required;
- (d) consents from depicted persons are available where individuals are recognisable.
The entrant indemnifies the organisers against any third-party claims arising from a breach of these warranties.
4.4 Usage rights to the submitted work
By submitting, the entrant grants the organisers a non-exclusive, unlimited (in time and territory), royalty-free right to use the work for all purposes of the Award, in particular: publication on the website and social media, press work, newsletter, previews, curated exhibition during the event, photo and video documentation of the event, and reporting on the Award. Copyright remains entirely with the entrant. Commercial exploitation outside the Award's communication requires separate written consent.
4.5 Exclusion of submissions
The organisers may reject submissions or exclude them from the competition without providing reasons, in particular in case of breach of these T&C, applicable law or public morals, or in case of well-founded suspicion of manipulation (e.g. of the public online vote for the People's Choice Award).
5. Jury & evaluation
5.1. The selection of finalists and prize winners is carried out by an expert jury appointed by the organisers. The jury decides independently, freely and finally.
5.2. No reasoning of jury decisions will be provided. Legal recourse is excluded.
5.3. The People's Choice Award is, by way of derogation, decided by a public online vote. The organisers reserve the right to invalidate abusive votes (e.g. bots, multiple voting).
6. Prizes & awards
6.1. The nature and scope of prizes are announced on the website prior to the start of the submission phase.
6.2. Material prizes cannot be exchanged for cash. Transfer to third parties is only permitted with the consent of the organisers.
6.3. Any tax obligations resulting from the receipt of a prize are borne by the prize winner.
7. Sponsoring
7.1. Sponsorship services are provided on the basis of individual sponsorship agreements. The packages described on the website (Title, Gold, Silver) and add-ons are non-binding offers and are specified in the individual contract.
7.2. Unless otherwise agreed in the individual contract, sponsorship contributions are due net within 14 days of invoicing. In case of payment default, default interest applies pursuant to § 456 UGB.
7.3. The sponsor provides their brand assets (logo, claim, image material) in suitable quality and with the licence required for the agreed use.
7.4. Cancellation and withdrawal terms are governed by the individual contract.
8. Tickets & event
8.1. Tickets for the Award gala are sold via a sales channel designated by the organisers.
8.2. Tickets are generally non-refundable and non-exchangeable, unless otherwise expressly indicated or excluded by law (in particular § 18 FAGG for events).
8.3. If the event is cancelled by the organisers, ticket costs will be refunded. Further claims (e.g. travel or accommodation costs) are excluded to the extent permitted by law.
8.4. The organisers may remove event attendees who violate house rules or safety instructions, without refund of costs.
9. Photo, image and audio recordings at the event
9.1. Photo, image and audio recordings will be made during the event for documentation, reporting and marketing purposes.
9.2. By entering the venue, attendees consent to the royalty-free use of these recordings for Award-related communication (website, social media, press, follow-up communication). The right to one's own image pursuant to § 78 UrhG applies within the scope of the legitimate interests of the organisers and of reporting on a contemporary event of public interest.
9.3. Persons wishing to object to use can contact service staff on site or write to hello@imagination-award.ai.
10. Consumer information / right of withdrawal
10.1. Consumers within the meaning of § 1 KSchG have a 14-day right of withdrawal pursuant to § 11 FAGG for distance contracts.
10.2. The right of withdrawal does not apply pursuant to § 18(1)(10) FAGG to contracts for services in connection with leisure activities (e.g. tickets for the Award gala) where a specific date or period is provided for performance.
10.3. For other contractual relationships (e.g. specific sponsoring aspects with consumer characteristics), the right of withdrawal applies exclusively in accordance with the FAGG.
11. Liability
11.1. The organisers are liable without limitation for damages caused intentionally or by gross negligence.
11.2. In the case of slight negligence, the organisers are liable, to the extent permitted by law and excluding personal injury, only for the breach of essential contractual obligations and only up to the amount of the typically foreseeable damage.
11.3. No liability is accepted for cloakrooms, valuables or electronic devices brought to the venue.
11.4. The organisers are not liable for damages caused by force majeure, official orders, strikes or comparable circumstances beyond the organisers' control.
12. Cancellation, postponement & force majeure
The organisers may cancel or postpone the event for important reasons (e.g. force majeure, official orders, illness of key participants, security situation). Existing tickets remain valid in the case of postponement, where possible. In case of full cancellation, ticket costs will be refunded; further claims are excluded.
13. Data protection
The processing of personal data is carried out in accordance with our privacy policy.
14. Trademarks & copyright of the website
All content published on the website (texts, layout, logos, organisers' image material, video) is protected by copyright or trademark law. Use outside the cases permitted by law requires the prior written consent of the respective rights holders. The "AI Imagination Award" trademark and the AIIA logo may only be used with the organisers' consent.
15. Online dispute resolution
The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. The organisers are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
16. Applicable law & place of jurisdiction
16.1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
16.2. Place of jurisdiction for all disputes arising from or in connection with these T&C is, to the extent permitted by law, Vienna.
16.3. Consumers within the meaning of § 1 KSchG may rely on mandatory more favourable provisions of their state of residence.
17. Final provisions
17.1. If individual provisions of these T&C are wholly or partly invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a regulation that comes closest to its economic purpose.
17.2. Amendments or supplements to these T&C must be in writing to be effective. This also applies to the amendment of this written-form requirement.
